This Personal Data Privacy Policy (hereinafter referred to as the Privacy Policy) applies to all information that the All Breeds Dogs website (hereinafter referred to as ABD), located under the domain name allbreedsdogs.com (as well as its subdomains), may obtain about the User while using the website allbreedsdogs.com (as well as its subdomains), its programs, and its products.

Definitions

1.1 The following terms are used in this Privacy Policy:

1.1.1. “Website Administration” (hereinafter referred to as the Administration) — authorized employees responsible for managing the ABD website, who organize and/or carry out the processing of personal data, as well as determine the purposes of personal data processing, the composition of personal data subject to processing, and actions (operations) performed with personal data.

1.1.2. “Personal Data” — any information relating to an identified or identifiable natural person (the subject of personal data).

1.1.3. “Processing of Personal Data” — any action (operation) or set of actions (operations) performed with personal data, with or without the use of automation tools, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction of personal data.

1.1.4. “Confidentiality of Personal Data” — a mandatory requirement for the Operator or any other person who has gained access to personal data to prevent its disclosure without the consent of the personal data subject or the presence of another lawful basis.

1.1.5. “ABD Website” — a set of interrelated web pages located on the Internet under a unique address (URL): https://allbreedsdogs.com/, as well as its subdomains.

1.1.6. “Subdomains” — pages or sets of pages located on third-level domains belonging to the ABD website, as well as other temporary pages, which indicate the Administration’s contact information at the bottom.

1.1.7. “User of the ABD Website” (hereinafter referred to as the User) — a person who has access to the ABD website via the Internet and uses the information, materials, and products of the ABD website.

1.1.8. “Cookies” — a small piece of data sent by a web server and stored on the user’s computer, which the web client or web browser sends back to the web server in an HTTP request each time it attempts to open a page of the corresponding website.

1.1.9. IP address — a unique network address of a node in a computer network through which the User accesses the ABD website.

General Provisions

2.1. Use of the ABD website by the User constitutes acceptance of this Privacy Policy and the terms of processing the User’s personal data.

2.2. If the User does not agree with the terms of the Privacy Policy, the User must stop using the ABD website.

2.3. This Privacy Policy applies only to the ABD website. ABD does not control and is not responsible for third-party websites that the User may access via links available on the ABD website.

2.4. The Administration does not verify the accuracy of personal data provided by the User.

Subject of the Privacy Policy

3.1. This Privacy Policy establishes the obligations of the Administration regarding non-disclosure and ensuring the protection of the confidentiality of personal data provided by the User at the request of the Administration when registering on the ABD website or subscribing to an informational email newsletter.

3.2. Personal data permitted for processing within the framework of this Privacy Policy are provided by the User by filling out forms on the ABD website and include the following information:
3.2.1. the User’s last name, first name, and patronymic;
3.2.2. the User’s contact phone number;
3.2.3. email address (e-mail);
3.2.4. the User’s place of residence (if necessary);
3.2.5. photograph (if necessary).

3.3. ABD protects data that are automatically transmitted when visiting pages:

  • IP address;
  • information from cookies;
  • browser information;
  • access time;
  • referrer (address of the previous page).

3.3.1. Disabling cookies may result in the inability to access parts of the website that require authorization.

3.3.2. ABD collects statistics on the IP addresses of its visitors. This information is used to prevent, detect, and resolve technical issues.

3.4. Any other personal information not specified above (browsing history, browsers used, operating systems, etc.) is subject to secure storage and non-disclosure, except in cases provided for in clause 5.2 of this Privacy Policy.

4.1. The Administration may use the User’s personal data for the following purposes:
4.1.1. Identifying the User registered on the ABD website for further authorization.
4.1.2. Providing the User with access to personalized website resources.
4.1.3. Establishing feedback with the User, including sending notifications, requests regarding the use of the ABD website, processing inquiries and requests from the User.
4.1.4. Determining the User’s location to ensure security and prevent fraud.
4.1.5. Confirming the accuracy and completeness of personal data provided by the User.
4.1.6. Creating an account to use parts of the ABD website, if the User has consented to account creation.
4.1.7. Sending email notifications to the User.
4.1.8. Providing effective technical support to the User in case of problems related to the use of the ABD website.
4.1.9. Providing the User, with their consent, with special offers, newsletters, and other information on behalf of the ABD website.

Methods and Terms of Processing Personal Information

5.1. The processing of the User’s personal data is carried out without any time limitation by any lawful means, including in personal data information systems with or without the use of automation tools.

5.2. The User’s personal data may be transferred to authorized state authorities of Ukraine only on the grounds and in the manner established by the legislation of Ukraine.

5.3. In the event of loss or disclosure of personal data, the Administration has the right not to inform the User about such loss or disclosure.

5.4. The Administration takes the necessary organizational and technical measures to protect the User’s personal information from unlawful or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions of third parties.

5.5. The Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data.

Rights and Obligations of the Parties

6.1. The User has the right to:

6.1.1. Freely decide on providing their personal data necessary for using the ABD website and give consent to their processing.

6.1.2. Update or supplement the provided information about personal data in case of changes.

6.1.3. Receive information from the Administration regarding the processing of their personal data, if such a right is not restricted by law, as well as require clarification, blocking, or destruction of personal data if they are incomplete, outdated, inaccurate, unlawfully obtained, or not necessary for the stated purpose of processing. To do this, it is sufficient to notify the Administration via the specified email address.

6.2. The Administration is obliged to:

6.2.1. Use the obtained information exclusively for the purposes specified in clause 4 of this Privacy Policy.

6.2.2. Ensure the confidentiality of information, not disclose it without the User’s prior written permission, and not sell, exchange, publish, or disclose the User’s personal data in any other way, except as provided in clause 5.2 of this Privacy Policy.

6.2.3. Take precautionary measures to protect the confidentiality of the User’s personal data in accordance with the procedures usually applied in business practice.

6.2.4. Block personal data related to the respective User from the moment of request or inquiry by the User, their legal representative, or an authorized body for the protection of personal data subjects’ rights, for the period of verification in case inaccurate personal data or unlawful actions are identified.

Liability of the Parties

7.1. The Administration that fails to fulfill its obligations shall be liable for losses incurred by the User in connection with the unlawful use of personal data, in accordance with the legislation of Ukraine, except for cases provided for in clauses 5.2 and 7.2 of this Privacy Policy.

7.2. In the event of loss or disclosure of confidential information, the Administration shall not be liable if such confidential information:
7.2.1. Became publicly available prior to its loss or disclosure;
7.2.2. Was obtained from a third party before it was received by the Administration;
7.2.3. Was disclosed with the consent of the User.

7.3. The User bears full responsibility for compliance with the legislation of Ukraine and the European Union countries, depending on their place of residence, including advertising laws, copyright and related rights laws, trademark and service mark protection laws, including full responsibility for the content and form of materials.

7.4. The User acknowledges that responsibility for any information (including, but not limited to, data files, texts, etc.) to which they may have access as part of the ABD website lies with the person who provided such information.

7.5. The User agrees that information provided as part of the ABD website may be intellectual property protected by law and owned by other Users, partners, or advertisers who place such information on the ABD website. The User may not modify, lease, loan, sell, distribute, or create derivative works based on such Content (in whole or in part), except where such actions are expressly permitted in writing by the owners of such Content.

7.6. With regard to text materials (articles, publications publicly available on the ABD website), their distribution is allowed provided that a reference to ABD is given.

7.7. The Administration is not liable to the User for any losses or damages incurred as a result of deletion, failure, or inability to save any Content or other communication data contained on or transmitted through the ABD website.

7.8. The Administration is not liable for any direct or indirect damages arising from the use or inability to use the website or its services; unauthorized access to User communications; statements or behavior of any third party on the website.

7.9. The Administration is not responsible for any information posted by the User on the ABD website, including information protected by copyright without the explicit consent of the copyright owner.

Dispute Resolution

8.1. Before filing a lawsuit regarding disputes arising between the User and the Administration, it is mandatory to submit a claim (a written or electronic proposal for voluntary dispute resolution).

8.2. The recipient of the claim must notify the claimant of the results of the claim review within 30 calendar days from the date of receipt, in writing or electronically.

8.3. If no agreement is reached, the dispute shall be referred to the Arbitration Court of Rivne.

8.4. The current legislation of Ukraine shall apply to this Privacy Policy and the relations between the User and the Administration.

Additional Terms

9.1. The Administration has the right to make changes to this Privacy Policy without the User’s consent.

9.2. The new Privacy Policy comes into force from the moment it is published on the ABD website, unless otherwise provided by the new version of the Privacy Policy.
